Terms & conditions


These Terms and Conditions govern the sale of goods by INKPOWER Limited ("We", "Us", "Our") to the customer ("You"). By placing an order with us, you agree to be bound by these Terms.

1. Prices, Specifications and Policies

  • 1.1 Pricing and GST
  • All prices are stated in New Zealand Dollars (NZD) and are inclusive of Goods and Services Tax (GST), unless otherwise clearly indicated as GST exclusive for trade purposes. The Supplier reserves the right to update prices and specifications at any time without prior notice.

  • 1.2 Errors and Availability
  • The Supplier endeavours to ensure price and specification accuracy but accepts no liability should goods be unavailable or if prices displayed differ from the intended sale price due to error or frequent market changes. Should an error occur after order placement, the Supplier will notify the Customer, allowing the Customer the option to proceed or cancel the order for a full refund.

  • 1.3 Retention of Title
  • Property in the goods shall remain the sole and absolute property of the Supplier until the Supplier receives full and cleared payment for all monies due.

  • 1.4 Risk
  • Risk in the goods shall pass to the Customer upon delivery to the address specified by the Customer. Delivery to a carrier shall constitute delivery to the Customer.
  • Page yields for printer consumables are meant for guidance purposes only and should only be used on that basis. For more accurate yield rates, please double check the manufacturer's specifications.  


2. Delivery, Returns, and Liability

  • 2.1 Freight and Delivery Time
  • Freight charges are based on the actual cost to the Supplier. Shipment and delivery dates are guidelines only and do not form a condition of sale. The Supplier accepts no liability for loss sustained by the Customer due to delayed delivery.

  • 2.2 Transit Damage Claims
  • Visible damage must be noted upon delivery. Any claim for concealed goods damaged in transit must be made to the carrier within three (3) working days of receipt of the goods.

  • 2.3 14-Day Returns
  • The Customer may return goods for a refund or replacement within 14 days of purchase, provided the goods are unopened and the original packaging is in pristine condition. The refund excludes original handling and shipping charges.


3. Exclusion of Consumer Guarantees Act 1993

  • 3.1 Business Acquisition
  • Where the Customer acquires the goods for the purposes of a business (as defined by the Consumer Guarantees Act 1993), the Customer agrees that the provisions of the Consumer Guarantees Act 1993 shall not apply to this contract.

  • 3.2 Sole Warranty
  • In such circumstances, the only warranty provided by the Supplier (express, implied, statutory, or otherwise) is the manufacturer's warranty accompanying the goods.

  • 3.3 Limitation of Liability
  • The total liability of the Supplier for any claim, loss, or damage whatsoever (including direct, indirect, and consequential loss) arising out of or in connection with this contract shall not exceed the price paid by the Customer for the specific goods which gave rise to the claim.


4. Financial Enforcement and Data Privacy

  • 4.1 Overdue Monies and Interest

  • The Supplier reserves the right to charge 2% interest per month on any overdue monies.

  • 4.2 Collection Costs
  • The Customer shall, upon demand, pay all of the Supplier's collection expenses, including Collection Agency fees and commissions, and all Solicitor and legal costs, incurred in the collection of any overdue amounts.

  • 4.3 Privacy and Credit Assessment
  • In accordance with the Privacy Act 1993, the Customer consents to the Supplier using and holding all personal information supplied for the purpose of obtaining credit reports, character references, or credit statements to assess the Customer's credit worthiness via a credit agency.


5. Miscellaneous Provisions

  • 5.1 Retail Security Policy
  • For retail store security: We operate Crime Prevention Cameras, recording images and video for security purposes, including reporting crimes to the Police. We reserve the right to publish images and video of individuals who commit theft or other crimes on our premises.

  • 5.2 Governing Law
  • These Terms are governed by and construed in accordance with the laws of New Zealand, and the parties submit to the non-exclusive jurisdiction of the New Zealand courts.

  • 5.3 Severability
  • If any provision herein is deemed void, unlawful, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
